1. Who we are
Olympic Cleaning Solutions (Pty) Ltd, trading as ShopXP (we, us or ShopXP), operates https://shopxp.co.za in South Africa. These terms apply to the website, customer accounts, orders, promotions and services we make available through ShopXP.
You can contact us at hello@shopxp.co.za. Our company registration number, physical address, telephone number, office-bearer details and address for service of legal documents must be inserted in the statutory disclosure once confirmed by the operator.
2. Acceptance and legal capacity
By using ShopXP or placing an order, you agree to these terms and the policies linked from them. At checkout you will have an opportunity to review and correct your order before submitting it.
You must be at least 18 years old and legally capable of entering into a binding agreement. If you act for a business or another person, you confirm that you are authorised to bind them.
3. Accounts and security
- Provide accurate, current information and update it when it changes.
- Keep your password and verification links confidential and tell us promptly if you suspect unauthorised access.
- You are responsible for activity on your account unless the activity resulted from our failure to use reasonable security measures.
- We may suspend an account to investigate fraud, abuse, security concerns or a material breach of these terms.
4. Products, descriptions and availability
We take reasonable steps to present product descriptions, specifications, images, compatibility information and stock accurately. Screen colours, packaging and minor manufacturer changes may differ from images without changing the product's essential characteristics.
Stock information may come from our warehouses or distributors and can change before an order is accepted. Products are subject to availability. We may limit quantities reasonably, including to prevent resale abuse or fulfilment errors.
5. Prices and errors
Prices are displayed in South African rand and include VAT where applicable. Delivery charges and any other disclosed charges are shown before payment. We do not add an undisclosed service fee at checkout.
If a genuine and obvious pricing, stock or description error occurs, we may reject or cancel the affected order before dispatch and refund amounts paid. We will contact you where reasonably possible and will not substitute a materially different product without your agreement.
6. Orders and contract formation
Submitting an order is an offer to buy. An automated acknowledgement confirms receipt, not final acceptance. A binding sale is formed when we send a dispatch confirmation or otherwise expressly accept the order after successful payment and stock validation.
We may decline an order for legitimate reasons including failed payment, unavailable stock, suspected fraud, delivery restrictions or an obvious error. If payment was taken for a cancelled order, we will initiate a refund to the original payment method.
7. Payment
Available payment methods are shown at checkout. Payments may be processed by Paystack or another disclosed payment service provider. The provider's secure environment may apply additional terms. We do not treat a browser redirect alone as proof of payment; an order is paid only after server-side verification.
You authorise us and our payment provider to process the amount displayed at checkout. You remain responsible for ensuring that you are authorised to use the selected payment method.
8. Delivery
Delivery charges, options and available estimates are shown at checkout for the address supplied. Dates are estimates unless we expressly agree to a fixed date. Our Shipping Policy forms part of these terms.
Risk passes to you when the goods are delivered to you or a person you authorised to receive them. Ownership passes only once we have received full cleared payment.
9. Cancellations, returns and warranties
Your rights under the Consumer Protection Act, the Electronic Communications and Transactions Act and other applicable law are not excluded or reduced. Our Returns & Refunds Policy explains cooling-off rights, defective goods, exclusions, assessments and refund timing.
Manufacturer warranties supplement, and do not replace, statutory rights. Warranty claims may require proof of purchase, serial numbers and reasonable diagnostic information.
10. ShopXP Rewards
If you join or use ShopXP Rewards, the ShopXP Rewards Programme Terms also apply. XP is a promotional loyalty unit, not cash, electronic money or a bank deposit. XP cannot be transferred or sold unless we expressly provide otherwise.
Earning, redemption, reversals, expiry if later enabled, level calculations and campaign eligibility are governed by the Rewards Programme Terms and the settings displayed in your XP Wallet or at checkout.
11. Promotions and vouchers
Promotions may have additional published rules, dates, eligibility requirements, stock limits, customer limits and budgets. Unless expressly stated, promotions cannot be combined, exchanged for cash or applied retrospectively.
We may correct or stop a promotion affected by fraud, abuse, technical error or exhausted stock or budget, while honouring accrued consumer rights and completed transactions where required by law.
12. Acceptable use
- Do not misuse the website, attempt unauthorised access, introduce malicious code or disrupt service.
- Do not use automated means to scrape the site in a way that degrades service or infringes rights.
- Do not submit unlawful, fraudulent, misleading, abusive or infringing content.
- Product content, branding, software and site design remain protected by applicable intellectual-property laws.
13. Responsibility and liability
Nothing in these terms excludes liability that cannot lawfully be excluded, or limits your statutory consumer rights. Subject to that rule, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.
We are not responsible for delay or failure caused by events outside our reasonable control, but we will communicate material delays and provide the remedies required by law.
14. Complaints and disputes
Please first contact hello@shopxp.co.za with your order number and a clear description of the issue. We will try to resolve complaints fairly and promptly.
You may approach the National Consumer Commission, an applicable consumer goods and services ombud or a court with jurisdiction. Nothing requires you to waive a statutory forum or remedy.
15. Changes, governing law and contact
We may update these terms prospectively. The version in force when an order is accepted governs that order unless a change is required by law or is more favourable to you. Material changes will be highlighted reasonably.
South African law applies. Electronic notices may be sent to the email linked to your account. Legal and customer-service queries may be sent to hello@shopxp.co.za.
